I refer to your email dated 1 February 2008 requesting details of prosecutions of Amateur licensees. I apologise for the delay in responding.

Unfortunately our database is presently not set up to readily provide the type of statistics you seek. 

Although only approximations are provided below, they are a good indication of the numbers of numbers of prosecutions, warning notices and range of offences involved.

   

Over the last 10 years approximately 10 Amateur licensees have been prosecuted under Sections 46 or 47 of the Radiocommunications Act 1992 (the Act - which can be viewed at the ComLaw website).  Most of those prosecutions were for operation of a radiocommunications device otherwise than as authorised by the Amateur’s apparatus licence.  

 

It is understood that most offences related to the operation of licensed Amateur stations in Amateurs spectrum, but not in accordance with a particular Amateur licence (eg operation by a Novice in Full Call spectrum or use of  more power than authorised)  

 

It is likely that some of those prosecuted would have previously been warned about similar offences. Some may have been previously issued with a penalty in lieu of prosecution for similar offences.
